EDITORIAL: Iccho Itoh's murder

市長殺害死刑―テロへの怒りを新たに

A former senior member of a gang affiliated to the nation's largest criminal syndicate was handed the death sentence Monday for the shooting murder of Nagasaki Mayor Iccho Itoh while he was campaigning for re-election in April last year.

長崎市の伊藤一長市長を選挙運動中に銃撃し、殺害した元暴力団幹部の男に、求刑通り死刑が言い渡された。

Prosecutors had sought the death sentence, which is rarely given when someone is accused of a single murder.

In explaining his decision to break with this tradition, the presiding judge of the Nagasaki District Court summed up his argument as follows:

殺された人が１人の場合、死刑判決はめったにない。あえて死刑を選んだ理由として、長崎地裁は次のように述べた。

（preside=司会をする、議長をする）（sum=意見を述べる、集約する）

The accused repeatedly made irrational demands of the city office, but because the city refused to comply with them, he came to bear a misdirected personal grudge against the mayor.

男は市役所に不当な要求を繰り返して拒まれたため、市長を逆恨みした。

（irrational=理屈に合わない、不合理な）（grudge=恨み、怨恨､遺恨）

He decided to flaunt his clout by killing the mayor and stopping his re-election.

市長を殺して当選を阻止し、自らの力を誇示しようと考えた。

（flaunt=誇示する）

Through the use of violence, the accused permanently deprived the mayor of his freedom to campaign and engage in political activity, and deprived voters of the chance to vote for Itoh.

His crime has shaken democracy to its foundations and cannot possibly be condoned.

暴力によって、選挙運動と政治活動の自由を永遠に奪い、有権者の選挙権の行使も妨害した。これは民主主義を根幹から揺るがす犯行だ。到底許しがたい――。

（condone=容赦する、多めに見る）

Trying to suppress free speech and political activity through violent acts amounts to waging terrorism on democracy.

暴力で言論や政治活動を封じようというのは、民主主義に対するテロである。

（amount to=という結果になる）(waging=事態が進行する､進む)

We believe the presiding judge opted for the most severe punishment under the criminal justice system because he was convinced of the gravity of the impact of this crime on society.

裁判官はテロの社会的な影響の深刻さを重く見て、いまある刑罰の中で最も重い死刑を選んだということだろう。

（opt for=のほうを選ぶ）

Even discounting the recent judicial trend toward harsher sentences, we still fully agree with the judge's implacable stance against terrorism.

厳罰化の流れが背景にあるとはいえ、そうしたテロに対する厳しい姿勢は十分うなずけるものだ。

（implacable=無慈悲な）

Since before World War II, there have been numerous acts of terrorism targeting politicians, business and opinion leaders.

政治家や経済人、言論人を狙ったテロは戦前から後を絶たない。

In Nagasaki, Itoh's predecessor suffered a serious gun injury at the hands of a rightist for acknowledging Emperor Showa's war responsibility.

長崎市では、「天皇の戦争責任はある」と発言した先代の市長が右翼団体の男に銃撃されて重傷を負っている。

Fear of terrorism and violence has cowed some people into inaction.

そうしたテロや暴力を恐れて、縮こまってしまう動きもある。

（cow=暴力などでおびえさせる）（inaction=不活動、無為、日和見）

For example, a Tokyo hotel denied the use of its conference rooms by the Japan Teachers Union (Nikkyoso).

More recently, some movie theaters "voluntarily" canceled showings of a controversial documentary by a Chinese director on Yasukuni Shrine.

東京のホテルが日教組の集会を断ったり、一部の映画館が「靖国」の上映を取りやめたりしたのは、その典型だろう。

Do we allow further terrorism and violence against democracy, or do we stand firm now and expand free speech and political activity?

The Nagasaki court's verdict is significant in the sense that it will have an influential bearing on these currents.

民主主義に対するテロや暴力をいっそうはびこらせるのか。それともここで踏みとどまって、言論や政治活動の自由を広げていけるのか。

そうした流れに影響を与えるという点でも、今回の判決は意味がある。

（bearing=挙動、姿勢、態度、振る舞い）

It is also worthy of note that the verdict represented an extremely tough stand against organized crime.

もうひとつ、判決で注目されるのは、暴力団にきわめて厳しい目を向けていることだ。

Noting that the accused committed an "act of violence against administrative authorities" for his own profit, the presiding judge denounced the accused for his "unpredecentedly vicious crime."

今回の事件について、行政を脅して利益を得ようとする「行政対象暴力」の中でも、「類例のない極めて悪質な犯行」と断罪した。

The judge noted: "(The crime) reminded the nation once again of the lawlessness of criminal syndicates and the horror of crimes perpetrated with firearms, and instilled deep fear in our entire society.

判決は「暴力団の無法さ、銃器犯罪の恐怖を改めて全国に知らしめることになり、社会全体を震え上がらせた。

（perpetrated=犯罪を犯す、悪事を働く）（instill=注ぎ込む、教え込む）

(The crime) also augmented the anxiety of employees of various administrative organizations." The judge went on, "Society has very strong expectations that a similar crime will never be allowed to happen again."

各自治体の職員などの不安を増大させた」としたうえで、「同種事犯の再発防止を求める社会的要請は非常に大きい」と指摘した。

The judge also asserted: "The motive of this crime, which was the accused's misdirected grudge against the mayor, was totally self-serving and typical of a member of a criminal syndicate. There was not a shred of extenuating circumstance to be taken into consideration." He is right.

判決はさらに「市長を逆恨みした犯行の動機は、暴力団特有の身勝手きわまりないもので、酌量の余地は全くない」と述べた。その通りだと思う。

Itoh's murder became the cue for revisions to the anti-organized crime law.

今回の事件をきっかけに、暴力団対策法が改正された。

（cue=手本）

Under the revised law, organized crime groups can be ordered to stop harassing authorities, for instance, when seeking to participate in the bidding process for public works projects.

行政の許認可への介入や入札への参加を要求する行為にも中止命令などを出せることになった。

（harass=苦しめる、悩ます）

We hope the police will work closer together with administrative authorities to eliminate criminal syndicates by every available legal means.

警察は行政と連携を強め、あらゆる法令を使って、暴力団を排除していってもらいたい。

We hope the Nagasaki District Court ruling will renew society's resolve to denounce terrorism and drive out all organized crime groups.

テロを憎み、暴力団を追いつめる。今回の判決を機に、その思いを新たにしたい。

（denounce=告発する、訴え出る）
