一部執行猶予 再犯防止の効果を見極めよ(22日付・読売社説)

The government presently is considering the creation of a new sentencing system for criminal trials that would introduce a middle ground between a prison sentence and a suspended sentence. However, even though the powers that be are heading in the appropriate direction, implementing such a system likely would prove problematic.

 実刑と執行猶予の中間に位置する新たな制度を設ける。その主眼は妥当だとしても、運用においては問題点が多いのも事実であろう。

The Justice Ministry has compiled a draft proposal to introduce a system for "partially suspending" the execution of a sentence, and another that would enable judges to issue offenders with orders to carry out community service. The ministry plans to submit a bill to revise the Penal Code and related bills to the Diet, possibly within the year, following the submission of a report on deliberations by the Legislative Council.

 法務省が「一部執行猶予制度」と「社会奉仕命令制度」の導入に向けた試案をまとめた。今年中にも法制審議会の答申を経て、刑法改正案などを国会に提出する。

Under the community service order system, offenders given suspended sentences with probationary supervision or released on parole would carry out unpaid duties such as cleaning up public facilities. It is hoped that by participating in such activities and working alongside volunteers, offenders would be able to take the first step toward rehabilitation.

 保護観察付きの執行猶予判決を受けた者や仮釈放者に、公共施設の清掃などを無報酬で行わせるのが社会奉仕命令だ。ボランティア活動への参加を更生のきっかけとすることに狙いがある。

Currently, about 60 percent of criminal offenses are committed by repeat offenders. Measures capable of thwarting recidivism are the key to restoring civil order. We think the community service order system should be constructed in such a way that it deters people from falling into a life of repeated crime.

 犯罪件数の6割を、再犯者による犯罪が占めている。一度罪を犯した者を再び犯罪に走らせない対策が、治安回復のカギである。社会奉仕命令を再犯防止策として、有効に機能させたい。

Partial suspension problematic

The partially suspended sentence system, which also is being viewed as a way of preventing recidivism, is, however, mired with difficulties.

 問題は、一部執行猶予制度である。これも再犯対策として検討されている。

Under the system, an offender who spends a certain period of time in prison will thereafter be allowed to lead a normal life in society, with the rest of the sentence being suspended.

 刑務所で一定期間、服役した受刑者が、満期までの残りの服役を猶予され、社会内で生活する。

For instance, a person might be sentenced to "imprisonment of three years with labor, of which one year is suspended for three years." As such, he or she will be incarcerated for two years and then be released. If such an individual stays out of trouble during the three-year stay of execution period, they will not have to return to prison.

 「懲役3年、うち1年について執行猶予3年とする」。この判決の場合、被告は2年間、刑務所で服役して出所する。3年間の執行猶予中に罪を犯さなければ、刑務所に戻ることはない。

The system would attempt to integrate offenders back into society via the process of rehabilitation.

 社会生活の中で規範性を身につけさせ、更生につなげる。

The government also is eyeing the system as a way of cutting prison sentences to ease the serious cell congestion at some penal institutions.

服役期間を短縮して、一部の刑務所で深刻な過剰収容状態を改善する狙いもある。

The current parole system is only brought into play when offenders have the requisite desire to rehabilitate themselves. Conversely, judges will decide whether to employ a partially suspended sentence before sentences are handed down.

 現行の仮釈放は、立ち直りの意欲のある受刑者に適用される。一方、一部執行猶予の適用については、判決を言い渡す段階で裁判官が判断することになる。

The new system would only apply to people with relatively light criminal responsibility, such as many first offenders.

 前歴がないなど、罪責が比較的軽い者が対象になるが、

Difficulties in application

However, it likely would be difficult to discern in advance whether a particular offender can be rehabilitated. As time spent in prison would be cut under the envisioned system, the government would have to enhance its prison-based correctional education programs.

更生の可能性を事前に判断するのは容易ではあるまい。服役期間が短縮される分、刑務所内での教育の密度を高める必要もある。

Furthermore, the inclusion of people sentenced over drug use could open up a can of worms. Under the new system, offenders would be able to lead normal and free lives, apart from receiving correctional education at local probation service offices if they are put on probation.

 薬物使用による受刑者が対象に含まれることも問題となろう。保護観察の下で、保護観察所などに通って更生教育を受ける以外は自由に生活ができるようになる。

Though such people would have to take periodic urinary examinations to deter them from using drugs again, is this solitary measure sufficient?

 再び薬物に手を出さないよう定期的な尿検査を実施するが、それだけで十分なのか。

We believe it is necessary for the authorities to reduce in number their supervisory blind spots.

目が行き届かない“死角”をできるだけなくすことが必要である。

In this sense, it is essential that the roles of probation officers and volunteer probation officers--the latter drawn from the ranks of the public--take on far more importance, as it is they who will offer guidance to offenders.

 指導役となる保護観察官や民間人の保護司の役割が一層、重要になることは間違いない。

A system for preventing recidivism should not open the way for people to reoffend. The government must therefore deeply ponder the validity of the system while guarding carefully against introducing it in a hasty and haphazard fashion.

 再犯を防ぐための制度が、再犯の呼び水になってはならない。拙速な導入を避け、制度の是非を慎重に見極めるべきである。
